The Sixth Circuit Court issued its decision on January 7, 2009 which vacated an EPA rule exempting pesticides applied on, over or near water bodies to obtain a National Pollutant Discharge Elimination System permit under the Clean Water Act. According to Keith Menchey, Manager of Science and Environmental Issues for the National Cotton Council, this week the 6th Circuit Court came out with its decision to grant the stay of its January decision.
