The 6th Circuit Court of Appeals’ ruling in January stated that any pesticide application from which any residue makes its way into the "waters of the U.S." are required to obtain a National Pollutant Discharge Elimination System permit or NPDES permit.

The 6th Circuit Court of Appeals’ ruling in January stated that any pesticide application from which any residue makes its way into the "waters of the U.S." are required to obtain a National Pollutant Discharge Elimination System permit or NPDES permit. National Cotton Council Chairman Jay Hardwick, says that because of the broad interpretation of U.S. waters, this ruling essentially established the requirement for all pesticide applications to be permitted under the Clean Water Act.
