In November 2006, the Environmental Protection Agency, or EPA, issued a final rule which allowed pesticide applications on or near water to be exempt under certain circumstances from National Pollutant Discharge Elimination System or NPDES permits.

 In November 2006, the Environmental Protection Agency, or EPA, issued a final rule which allowed pesticide applications on or near water to be exempt under certain circumstances from National Pollutant Discharge Elimination System or NPDES permits.  Keith Menchey, manager of science and environmental issues for the National Cotton Council, says that on January 6, 2009, the sixth circuit court ruled against the rule, invalidating it.
