Earlier this year the Sixth Circuit Court of Appeals vacated EPA’s 2006 rule which had exempted pesticides applied near or into waters from National Pollutant Discharge Elimination System or NPDES permits if applied in accordance with the FIFRA label.

Earlier this year the Sixth Circuit Court of Appeals vacated EPA’s 2006 rule which had exempted pesticides applied near or into waters from National Pollutant Discharge Elimination System or NPDES permits if applied in accordance with the FIFRA label.  According to Keith Menchey, Manager of Science and Environmental Issues, this decision would mean pesticide applications will require an NPDES permit.
