Earlier this year the Sixth Circuit Court of Appeals vacated EPA’s 2006 rule which had exempted pesticides applied near or into waters from National Pollutant Discharge Elimination System or NPDES permits if applied in accordance with the FIFRA (pronounced fif-ra) label.

Earlier this year the Sixth Circuit Court of Appeals vacated EPA’s 2006 rule which had exempted pesticides applied near or into waters from National Pollutant Discharge Elimination System or NPDES permits if applied in accordance with the FIFRA (pronounced fif-ra) label.  According to Keith Menchey, Manager of Science and Environmental Issues, this decision would mean pesticide applications will require an NPDES permit.

Menchey says The Council requests that other industry petitioners join them and the USDA in expressed concern over this issue.
